On May 31, 2013, Mr. H swung his car to the left and attempted an impossible pass on a two-lane road. His reckless decision resulted in a head on collision with Ms. C. Our witnesses stated that when Mr. H hit Ms. C’s oncoming vehicle, it sounded like cans crushing together. Both vehicles overturned due to the force of the crash. Ms. C’s vehicle came to rest in a ditch near a church. She was forced to crawl through a window.
When Richland County EMS arrived at the crash scene, they noted Ms. C’s left arm, left knee, and face were lacerated. EMS also observed swelling to the left leg and a substantial hematoma on the left thigh. Ms. C’s injuries required transport by EMS to the Palmetto Health Richland ER (“PHR”). X-rays revealed a fracture in her left foot and ankle. Ms. C was therefore required to wear a cast for several weeks. The injuries also prevented Ms. C from working for several weeks.
On October 2, 2012, Tracy Hill, P.T., conducted a Functional Capacity Evaluation (“FCE”) with regard to Ms. C’s left leg and ankle. When Ms. C arrived for the FCE, her left ankle was swollen. The swelling worsened throughout the FCE. Upon completion of all tests, Ms. Cotton was found to suffer from 7% impairment to her left ankle.
Though her medical bills were less than $5,000.00, we were able to reach a settlement of nearly ten times that amount based on the Defendant's recklessness, as well as Ms. C's permanent injury.
