What can you do to find a top workers' compensation lawyer in Lexington, South Carolina? My name is Kenneth Berger, and I represent injured workers in Lexington and across our state. Are other attorneys in the area referring him or her cases because they know they're going to do a good job? And third, and this might be very important, in fact, most important, you want someone who is going to respect you; you want someone who understands what it's like to get knocked out of work, face medical bills, have uncertainty over your financial future and future employment. You want someone who's really on your side and is going to be able to get to know you well enough to effectively represent your interest and tell your story before our workers' compensation commission. How Much Does Workers' Comp Pay?

The amount of compensation you receive is based on two-thirds (2/3) of your pre-tax weekly earnings. For instance, if you grossed an average of $600.00 per week before your accident, you would be entitled to weekly checks of $400.00. Most people call these weekly payments “workers’ comp checks.” In legal terms, they are known as payments for “temporary total disability.” You are temporarily unable to perform your job and should, therefore, be compensated.

How Often Will I Receive Workers' Comp Checks?

The injured employee would continue to receive a workers’ comp check unless the wages from his new job matched his pre-accident earnings. Specifically, the insurance company would have to issue weekly workers' comp checks for two-thirds of the difference between his old and new earnings. This type of workers’ comp check is known in the law as payment for “temporary partial disability.” Once again, the idea is that you must be compensated if you are unable to complete a full return to your former job.
