Does a positive drug test keep you from getting workers' comp benefits in South Carolina? I'm Kenneth Berger. In fact, it's your employer's insurance company that has the burden of proving not only that you were impaired by drugs or alcohol, but that your impairment from the drugs or alcohol is what caused your accident. Now, your employer, your co-workers, and the insurance company might all be telling you that a positive drug test keeps you from filing a workers' compensation claim. We've heard that before. However, it's not true. Unless the insurance company can affirmatively prove that drugs or alcohol were actually the cause of the accident, you can still receive benefits related to the injuries you sustained.
