The Medical Transport Company’s Negligence
Our client, a 51-year-old mother, and a leg amputee, was being taken to a medical appointment on September 10, 2020, by a medical transport company (name withheld due to confidentiality agreement). The driver of the transport van was talking on her cell phone for the duration of the drive and continued to do so as she pushed our client’s wheelchair down the van’s ramp. The wheelchair picked up speed and flipped backward onto the pavement.
Our client’s hand was crushed by the chair, and she was left lying on the pavement embarrassed and in pain. The driver finally got off her cell phone after the incident as our South Carolina personal injury attorney explains.
Damages - More than Medicals
Our client underwent surgery on her middle finger, which later became infected and required two debridement procedures. She also underwent occupational therapy but has yet to gain full function of her hand and finger.
But this case was about much more than medical bills. Our client was a proud mother and grandma who was no longer able to dress herself and cook for her family. A prior leg amputation had never prevented her from being who she wanted to be, but coupled with her new hand injury, her freedom was stripped away, and she was no longer able to take part in the most valuable parts of her life.
In this case, we did not seek medical damages. Instead, we focused on the physical pain, mental anguish, and lost enjoyment of life she endured because the driver chose to talk on her cell phone, rather than focus on our client’s safety.
A $2.5 Million Settlement
The medical transport company did not respond to the lawsuit. At the damages hearing, our client gave a powerful testimony about how her life and her most valuable asset – her relationship with her family - had been affected by the incident. Our legal team was proud to secure a $2,500,000 settlement on her behalf.
