Mr. H was working on a hydraulic lift in Orangeburg, when the lift operator accidently ran him into a wall, crushing Mr. H’s left arm, and knocking him out of the hydraulic lift basket. Mr. H landed on his right side, injuring his ribs.
The workers' comp insurance company initially refused to compensate Mr. H for the injury to his arm and ribs. They argued that the injury was limited to Mr. H's collarbone, and was therefore of little value. The insurance company also claimed that Mr. H's average weekly earnings - and resulting compensation rate - were much lower than we ultimately proved them to be.
After a series of conversations, and several emails, the insurance adjuster ultimately agreed to the large majority of our demands, and decided to settle the workers' comp claim for two times what had originally been offered.
