Does a positive drug test keep you from getting workers' comp benefits in South Carolina? I'm Kenneth Berger. I'm a Columbia workers' compensation lawyer, and I made this video to answer that question. Now, we in no way condone drug use, but we did make this video to tell you that a positive drug test doesn't always keep you from receiving workers' comp benefits. In fact, it's your employer's insurance company that has the burden of proving not only that you were impaired by drugs or alcohol, but that your impairment from the drugs or alcohol is what caused your accident. Now, your employer, your co-workers, and the insurance company might all be telling you that a positive drug test keeps you from filing a workers' compensation claim. We've heard that before. However, it's not true. Unless the insurance company can affirmatively prove that drugs or alcohol were actually the cause of the accident, you can still receive benefits related to the injuries you sustained. If you were severely injured or if you just have questions about the workers' compensation process, especially after a positive drug test, know that we're here to help you and we're here to protect your rights. We're not here to judge you. You can reach me and set up a free consultation by calling our office or using the live chat feature on the website. You can also request free copies of my books right here on the site. Either way, know that we're here to help protect you along with your legal rights.
South Carolina Worker's Compensation
In South Carolina, if you have been injured at work, you are entitled to compensation to help pay for medical bills, lost wages, and other damages. Whether you have suffered a relatively minor injury or sustained a major injury that could potentially prevent you from returning to work, you have the right to claim your workers’ compensation benefits. You should never feel guilty about filing a workers’ compensation claim. The South Carolina Workers’ Compensation system is designed to protect the legal rights of workers and ensure they are treated fairly after a workplace injury.
